1. Acceptance of Terms
By accessing or using the services provided by Dhirender Tiwari & Associates ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Scope of Services
Our firm provides financial advisory, tax consulting, GST filing, MCD factory licensing representation, startup incorporation support, trademark filings, and corporate auditing services. All advisory services are based on the information provided by the client, and the accuracy of such services is dependent on client transparency.
3. Professional Integrity & Compliance
In accordance with regulations laid down by the Institute of Chartered Accountants of India (ICAI) and applicable Indian tax laws (including the Income Tax Act 1961 and CGST Act 2017), we maintain the highest ethical standards. We reserve the right to decline representations or filings that run contrary to statutory compliances or involve falsified accounts.
4. Client ResponsResponsibilities
Clients must provide accurate, complete, and timely documentation required for filings (such as PAN, Aadhaar, bank records, and invoice histories). We are not responsible for penalties or interest charges arising from client delays, failure to provide authentic files, or missed statutory deadlines.
5. Consultation Fees & Payments
Fees are quote-based, depending on the turnover, transaction volume, and legal complexity of the representation. Government filing fees (for trademark, startup registries, factory license deposits, etc.) are separate from professional consulting fees and must be cleared in advance. All quotes are final.
6. Limitation of Liability
While we use professional diligence to secure licenses and accurate filings, decisions by government departments (such as Income Tax Assessments, GSTIN approvals, or MCD licensing officers) are beyond our direct control. We are not liable for business interruptions or regulatory rejections resulting from official departments.
7. Termination
Either party may terminate the consulting agreement upon written notice. Upon termination, the client remains responsible for clearing all professional service fees accrued up to the termination date.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, Delhi.
